New idea about those Horcruxes

I've just been listening to HBP again. It just struck me that maybe the count is off. What if the main Horcrux(Voldie) was killed when he attacked Harry as a baby. That would leave only six left, not seven. Evidence of that would be the form that voldermort came back as. He was without a body. Maybe Pro. Quirl or Bertha came across one of those horcruxes and that was how he was reborn, by the Horcrux possessing one of them. Maybe the snake is just a snake after all. Any thoughts?
